These Terms of Service (“Terms”) govern your use of Backshop, a missed-call text-back service operated as a sole proprietorship based in Newburgh, Indiana. By signing up for Backshop or using our service, you agree to these Terms.

Backshop provides an automated text reply system for local service businesses. When a customer calls a phone number provisioned by us and the call is not answered, our system automatically sends the caller a single text reply on behalf of the business. Our service also sends notification alerts to the business owner about missed calls, and logs caller information to the business's contact management system.
Consent. By providing your phone number during signup at getbackshop.com, or by replying to a Backshop-operated number, you consent to receive text messages from our service related to the operation of your account (for business owners) or the business you have called (for callers). We do not send marketing or promotional text messages.
Backshop is sold as a monthly subscription at $49 USD per month per business. Subscriptions:
Cancellations take effect at the end of the current billing period. We do not pro-rate refunds for partial months unless required by law.

We reserve the right to suspend or terminate accounts that violate these rules.
We aim for high reliability but do not guarantee uninterrupted service. Backshop depends on third-party providers (Twilio, Stripe, and others) whose outages may temporarily affect our service. We are not liable for missed messages, missed calls, or lost revenue caused by service interruptions, carrier issues, or events outside our reasonable control.
Backshop is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or the service is limited to the amount you paid us for the service in the 12 months immediately preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages.
You retain ownership of your business data, including the caller logs and contact information collected through your use of the service. You can export your data at any time. We retain a limited right to use anonymized, aggregated data to operate, improve, and analyze the service.
We may update these Terms occasionally. When we make material changes, we will update the “Last updated” date at the top of this page and notify active business clients by email. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
You may cancel your account at any time. We may suspend or terminate accounts that violate these Terms, fail to pay, or pose risk to other users or the service. Upon termination, your access to the service ends, but provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, and dispute resolution) will continue to apply.
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the service will be resolved in the state or federal courts located in Vanderburgh County, Indiana, and you consent to the jurisdiction of those courts.
